1. Introduction
These Terms & Conditions govern the provision of building and construction services by Optima Builders Ltd (“we“, “us“, or “our“). By engaging our services or visiting our website (www.optimabuilders.co.uk), you agree to be bound by these Terms.
2. Our Services
We provide construction, renovation, extension, loft conversion, carpentry, plumbing, decorating, and related services throughout North and North-West London. The exact scope of services will be detailed in a written quotation and confirmed before any work begins.
3. Quotations and Contracts
All quotations are provided free of charge and are valid for 30 days unless otherwise stated. A binding contract shall exist once our quotation has been accepted either in writing or by conduct, including (but not limited to) the payment of a deposit or the commencement of works.. Variations to the work must be agreed upon in writing.
4. Payments and Invoicing
Payments shall be made according to the stage payment schedule agreed with the client (usually weekly or fortnightly) to ensure steady cash flow and progress of works.
Invoices must be settled within 7 days of issue unless otherwise agreed. Late payments may incur interest.
A final retention payment shall be due immediately upon completion and acceptance of all works by the client and, where applicable, Building Control.
Deposits are required to secure start dates.
5. Project Timelines
We aim to complete all work within the agreed timeline. All dates provided are estimates given in good faith.
Delays may occasionally occur due to factors beyond our control, such as weather, material shortages, late deliveries, Building Control inspections, or other unforeseen circumstances.
In such cases, we will communicate promptly with the client and agree a revised schedule.
Payments will only ever be requested for works actually carried out.
6. Client Responsibilities
The client must ensure access to the property and provide accurate information before and during the project. Where necessary, the client must obtain permissions, including planning or Party Wall agreements.
The client shall promptly review and approve any design or specification changes required.
Any additional works requested by the client, or required due to unforeseen conditions not visible at the time of quotation, will be treated as a variation. Such variations will be agreed in writing and charged in addition to the original contract sum.
7. Guarantee and Defects
We provide a 12-month workmanship guarantee on all services unless otherwise specified. Material warranties may be covered by manufacturers. Any defects must be reported in writing within a reasonable time.
8. Health & Safety
We comply with all UK Health & Safety regulations. Clients and third parties must not interfere with our work or enter active work areas without permission.
9. Insurance
We carry full public liability and employer’s liability insurance.
10. Limitation of Liability
We are not liable for: – Pre-existing structural issues. – Delays due to third parties. – Losses arising from client instructions contrary to professional advice.
11. Termination
Either party may terminate the contract with written notice under the terms specified in the quotation. Charges may apply for works completed to date and materials ordered.
12. Complaints and Dispute Resolution
All complaints must be submitted in writing. We will respond within 14 days. In case of disputes, we aim to resolve matters amicably. Legal action may be taken only after other options have been exhausted.
13. Privacy and Data Protection
We comply with the Data Protection Act 2018 and GDPR. Personal data collected via our website or direct communication will only be used to deliver services, handle enquiries, and send invoices. See our full Privacy Policy for details.
14. Governing Law
These Terms are governed by the laws of England and Wales.
